Terms and Conditions

Please read these Booking Conditions carefully as they include crucial details. You must read them well and comprehend them. The Booking Conditions establish your legal connection with Trekgoindia and serve as a legally enforceable contract between you and Trekgoindia for the services supplied by Trekgoindia. By making a reservation, you confirm that you have read these Terms & Conditions in full, understand them, and agree to be bound by them. We will confirm your booking by sending you an email or letter indicating that we have accepted it, at which point a contract between us will have been formed. Please contact a member of our staff if you have any questions or concerns about these Terms and Conditions or if you have any trouble understanding any part of it.

1)VALUE AND COST

Any remaining balance must be paid in full before the trip begins. In the event that the remaining amount is not paid, the registration will be cancelled and the corresponding cancellation fees will be assessed. The trip’s participants are responsible for covering any and all “extra” costs that may arise. Credit card purchases may be subject to an additional fee of up to 2.35 percent.

 

2) ASSUMPTION OF RISK AND YOUR TRIP 

Trekgoindia offers tours in less developed parts of the world, so you should be prepared for a drop in comfort from the amenities and services you’re accustomed to at home when it comes to lodging, transportation, safety, sanitation, medical care, and other infrastructure. You understand that there are potential dangers associated with all Trekgoindia treks that may not be present on more sedate vacations when making your reservation. Injury, death, mental anguish, illness, property loss or damage, inconvenience, and pain are all possible outcomes.

 

3)LIABILITY WAIVER

Trekgoindia shall use appropriate care and competence while it is providing a service. Trekgoindia is not liable for any loss, damage, death, injury, or expenditure (including loss of money paid in advance) you may suffer as a result of the activities or omissions of others, such as tour guides or lodging providers. If you break the law in any of the countries or regions you visit, Trekgoindia is not responsible and will not compensate you. All pre- and post-trek accommodations not booked via Trekgoindia are considered extras, and Trekgoindia makes no guarantees or warranties for them. Subject to the exceptions set forth below, Trekgoindia does not assume responsibility for any loss, death, injury, or damage, however, caused (including through negligence), that you may incur in connection with or arising out of this contract or your participation in a tour/trek, or in respect of a failure or omission on the part of Trekgoindia to comply with its obligations under this contract. You further agree to hold harmless Trekgoindia and its employees and representatives (“Representatives”) to the fullest extent permitted by law and subject to the exception set out below, and to waive any claims you may have against Trekgoindia or its Representatives as a result of your participation in any Tour/Trek.

 

4)CANCELLATION BY TREKGOINDIA

If for whatever reason Trekgoindia has to cancel a departure, you will be notified no later than 7 days before your scheduled departure. Trekgoindia retains the right to cancel any departure in the event of a ‘Force Majeure’ event. Trekgoindia will give you other Treks/tours if your original reservation is cancelled, and if the price of your alternate booking is lower than the price of your original reservation, we will reimburse the difference to you. If you do not agree to the new terms, we will return any money made, less any costs we incurred due to the early reservation. Trekgoindia is not responsible for any extra expenses you may incur. If your Trekgoindia trip is delayed, altered, or cancelled due to “Force Majeure,” Trekgoindia will not be held responsible. Trekgoindia shall not be held liable for any cancellations, delays, or other disruptions in service caused by events outside of its control, such as war, threat of war, riots, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather, fire, strikes, or other similar occurrences.

 

5)CANCELLATION BY YOU

You must inform Trekgoindia in writing (including through email) if you need to cancel all or part of your reservation. If you notify Trekgoindia of your cancellation through email or regular mail, your cancellation will take effect on the day Trekgoindia receives your notice. The following fees apply per passenger in the days leading up to the departure:

  • The majority of your payment for your trek or tour will be reimbursed if you cancel up to 24 days before departure.
  • 70% of the Trek/Tour Fee will be Refunded if Canceled Between 14 and 24 Da.
  • Half of your Trek/Tour Fee will be Refunded if you Cancel Between 14 and 8 Days Before Departure.
  • Under 10 days: – Absolutely no returns
  • Taxes, fees, and charges incurred by the payment gateway are not refundable under any circumstances.

 

6)CHANGES TO YOUR HOLIDAY

You agree that travelling with Trekgoindia needs some adaptability, a sense of humour, and an awareness that local conditions may necessitate changes to the schedule, lodging, and/or transportation at any time, even after a trip has begun. Force Majeure, inclement weather, road conditions, ticket availability, vehicle breakdowns, altered transport timetables, and other unforeseen or uncontrollable events may necessitate itinerary adjustments or cancellations. Any disappointment, extra waiting time, or other inconveniences not caused by Trekgoindia will not be compensated for. You understand that the number of people in your tour group may fluctuate during the course of the trip. We have the right to make adjustments to the itinerary if necessary. You should check the Pre-Departure Information and Trip Notes for the most recent updates. You may get them through Trekgoindia.com. Both the Trip Notes and the Pre-Departure Information are considered to be contractually binding documents. If there are any changes to your trip after you have received your final documents, we will do our best to let you know. In the unlikely event that an evacuation is necessary, the participant, and not Trekgoindia, will be responsible for paying any associated costs. The evacuee is responsible for any additional costs associated with their trip as a result of the evacuation.

 

7)LEADERSHIP AUTHORITY

Regarding any and all issues that might have an impact on the trip’s safety and well-being, the decision of the Trekgoindia Tour/Trek leader or representative shall be final. Any and all decisions made by your Trekgoindia Leader about your continued participation in the trip or specific activities will fall under this category. The Trekgoindia Leader retains the right to cancel this contract and ask you to leave the trip immediately, with no right of reimbursement, if you fail to comply with a decision made by the Trekgoindia Leader or interfere with the well-being of the group.
